These Terms and Conditions ("Terms") govern your use of the Bathware Plus website and any purchase you make through our online store for bathroom fixtures, tapware, vanities, showers and related products. By browsing our site or placing an order, you are agreeing to be bound by these Terms.

We may update these Terms from time to time, and the current version will always be posted on our website. Unless the law requires otherwise, whichever version of these Terms was live at the moment you placed your order is the version that applies to that order.

Nothing in these Terms takes away from, limits, or overrides any consumer protections you are entitled to under the Australian Consumer Law (ACL) — where those protections cannot be excluded by law, they continue to apply in full.

1. Who These Terms Cover

These Terms apply to everyone who browses our website, sets up an account, or buys a product from Bathware Plus, unless we have agreed something different with you in writing. Using our site, submitting an order, or completing a purchase means you accept these Terms in full.

2. How Orders Work

Placing an order through our online store is you making an offer to buy the item(s) in your cart — it is not a guaranteed sale until we accept it. We may decline or cancel an order at any time before it leaves our warehouse if we spot:

  • a pricing, freight, product or description mistake;
  • insufficient stock to fulfil it;
  • a problem processing or verifying your payment;
  • signs of fraud or an unauthorised transaction;
  • misuse of a discount code or promotional offer; or
  • a technical fault, website migration issue, or system or integration error.

Receiving an order confirmation email simply tells you we have your order in our system — it is not automatic proof that we have accepted it. Unless we say otherwise, we treat an order as accepted once it has been dispatched.

3. About Our Product Listings

Because we work with a range of external suppliers and manufacturers, product details can shift without warning — things like measurements, colours and finishes, included fittings and accessories, packaging, branding, model or product codes, and other specifications.

We do our best to keep descriptions, photos, dimensions and specifications on our site accurate and current, but some of that information comes directly from our suppliers and may lag behind their most recent production run or update.

Photography — including lifestyle imagery — is there to give you a general sense of the product, not an exact preview. What arrives at your door may differ slightly from what is shown on our website, in a spec sheet, or supplied from an earlier batch.

When you buy from us, you acknowledge that:

  • images are illustrative and might not perfectly match the item you receive;
  • colours and finishes can look different depending on your screen, lighting conditions, and how a product was photographed;
  • small inconsistencies can occur between manufacturing batches;
  • our suppliers can alter specifications, dimensions, accessories, inclusions or packaging without advance notice; and
  • we may supply whatever current version of the product our supplier has on hand at the time your order ships.

A minor difference that does not affect how a product works, what it is meant for, or its overall character is not treated as a fault or a case of mis-description, and on its own will not qualify you for a refund, return, exchange, or compensation for a change of mind. If you notice something that genuinely affects the product's function or key features, contact us in writing as soon as possible — ideally before you install or use it.

A Note on Batch Variation

Even the same product line can vary slightly from one supplier shipment to the next — in colour tone, finish, hardware, packaging, branding, or minor specifications.

4. Pricing, Quotes and Website Errors

We take care to make sure prices, freight costs, product descriptions and other details on our website are correct, but mistakes can occasionally slip through.

If something is listed with the wrong price, freight fee, specification, or description — whether that is down to a typo, a supplier error, a system glitch, a migration issue, or human error — we may cancel the order, ask you to pay the correct amount, or correct the order before it is shipped.

Any quote we provide is indicative only unless we have confirmed it in writing, and even then it can still be affected by stock levels, freight costs, and changes in what our suppliers charge us.

5. Promotions, Sales Events and Discount Codes

Peak sales periods tend to bring higher order volumes, which can mean slower dispatch, stock levels that shift quickly, temporary backlogs, and longer waits for a response from our team.

  • Generally, only one discount code or promotion applies per order unless we say otherwise.
  • Stacking multiple codes together is not permitted.
  • Promotional pricing usually cannot be combined with trade or negotiated pricing, clearance stock, or other offers, unless we specifically say it can.
  • Discount codes need to be entered at checkout — we generally cannot apply them retroactively once your order is placed.
  • We may change, pause, or end a promotion at any point, within the bounds of the law.

Please keep in mind that dispatch times and customer service responses may take longer than usual during peak sale periods.

6. How Payment Works

Unless we have agreed otherwise with you in writing, full payment is required before your order is dispatched.

We may hold off on dispatching an order if a payment is still pending, being reviewed, has been reversed, is under dispute, or appears to be unauthorised.

7. Shipping, Delivery and Freight

Any timeframes we give for dispatch or delivery are estimates unless we have confirmed a specific date with you in writing.

Large or bulky items are typically delivered kerbside unless we have arranged something different in writing. It is your responsibility to make sure the delivery address is safely and reasonably accessible for the delivery driver.

You may be charged extra for freight or a repeat delivery attempt if:

  • your address falls outside our standard delivery zones or is considered remote;
  • a delivery attempt fails and a redelivery is needed;
  • the delivery needs special equipment or extra manual handling;
  • the freight charge was miscalculated the first time around; or
  • you change the delivery address after placing the order.

We are not responsible for delays caused by things outside our control — third-party couriers, supplier hold-ups, warehouse congestion, extreme weather, public holidays, customs processing, industrial action, and similar events.

8. Inspecting Your Delivery and Reporting Transit Damage

Please check everything you receive carefully within 48 hours of delivery, and before you install it, use it, or dispose of the original packaging.

If your delivery arrives damaged, wrong, incomplete, or otherwise not as expected, please:

  • let us know in writing within 48 hours of delivery;
  • send us clear photographs of the packaging, the shipping label, and the item itself;
  • keep all original packaging until the matter has been resolved; and
  • avoid installing, using, altering, or disposing of the affected item.

If you do not report transit damage or a delivery issue within that 48-hour window, it may limit our ability to lodge a claim with the courier, and in turn what we are able to do to help.

If a product is installed or used after damage was already visible, or after it was clear the wrong item had been sent, we may not be responsible for the cost of installation or related expenses, except where the law says we must be.

A Quick Reminder: Inspect Before You Install

Take a good look at what you have received before booking a tradesperson or disposing of the packaging. If you spot visible damage, a missing part, or the wrong product, reach out to us before installation goes ahead.

9. Ownership of Goods

Ownership of any product stays with Bathware Plus until you have paid for it in full and that payment has cleared.

If a payment bounces, is reversed, charged back, or later found to be unauthorised, we reserve the right — within what the law allows — to recover the goods and pursue the amount still owing.

10. Pre-Order and Backorder Items

Some items are only available to pre-order, backorder, or specially order in from a supplier. Any expected arrival or dispatch date we give you is based on information from our supplier, and it can change.

We are not responsible for delays on the supplier's end — manufacturing hold-ups, freight delays, customs processing, or any other supply chain disruption outside our reasonable control.

11. Custom, Special-Order and Non-Stock Products

If a product has been custom-made, specially sourced for you, made to order, or is not something we normally stock, we generally cannot cancel, return, exchange, or refund it for a change of mind once we have confirmed the order with our supplier, unless the law requires it.

This includes custom finishes, non-standard sizes, supplier indent orders, and other bespoke configurations — these are usually treated as non-cancellable and non-returnable for change of mind, subject to whatever rights you have under the law.

12. Changing Your Mind About a Purchase

We may, at our discretion, agree to a change-of-mind return, but we are not obligated to if the product is not faulty and has not failed to meet a consumer guarantee that applies to it.

Where we do approve a change-of-mind return, the following conditions usually apply:

  • you need to ask us in writing and get our approval before sending anything back;
  • the item must be unused, not installed, undamaged, and fit to be resold;
  • it needs to go back in its original packaging, with every accessory, part, manual and protective wrapping included;
  • please do not write on, stick labels to, or tape directly onto the original product packaging; and
  • you will need to show proof of purchase.

An approved change-of-mind return can attract a restocking fee of up to 20% (or more, where that reflects an actual fee our supplier charges us), plus the cost of outbound and return freight and any reasonable administration or handling charges. Freight costs are generally non-refundable once an order has left our warehouse.

For hygiene and resale reasons, some products are excluded from change-of-mind returns altogether. This can include toilet seats, bidet seats, sanitary items, opened consumables, clearance stock, spare parts, and custom or special-order products, except where the law entitles you to a return or remedy regardless.

13. Cancelling an Order

If you ask to cancel before your order is dispatched, we may agree to it at our discretion, subject to the law.

If your order has already been packed, handed to a courier, specially ordered, or locked in with a supplier by the time you ask to cancel, we may pass on any reasonable costs this creates — for example, supplier cancellation fees, restocking charges, administration fees, and freight.

14. Faults, Damage and Warranty Claims

If you believe a product is faulty, damaged, or does not meet a consumer guarantee it should, please let us know as soon as you can.

We may ask for photographs, your order details, and any other information that helps us assess the issue properly. Where the law allows, we may need the product inspected, returned, tested, or assessed by the supplier or manufacturer before we can settle on the right remedy.

Please do not install a product if you can see it is damaged, faulty, or the wrong item before you start — we are not responsible for installation costs on a product that had a visible problem before it went in, except where the law says otherwise.

Any warranty offered by the manufacturer sits on top of, and does not replace, your rights under the Australian Consumer Law.

15. Your Rights Under the Australian Consumer Law

Nothing in these Terms cuts down, restricts, or changes any right or remedy you have under the ACL or any other law that cannot be excluded.

Our products come with guarantees under Australian law that we cannot contract out of. Depending on what has gone wrong, you could be entitled to a repair, a replacement, a refund, or compensation for loss that was reasonably foreseeable.

For a failure that is not major, we will offer a suitable remedy in line with the ACL. Where a failure is major, the choice between a refund and a replacement is generally yours.

16. Limits on What We're Liable For

To whatever extent the law allows, Bathware Plus will not be liable for indirect or consequential losses — lost profit, a missed opportunity, a delayed project, or similar flow-on effects — except where that liability cannot legally be excluded.

We are not responsible for costs charged by plumbers, builders, electricians, tilers, installers or other tradespeople, unless the law — including the ACL — says we must be.

17. What We Expect From You as a Customer

It is on you to:

  • confirm a product's dimensions, finish and specifications suit your needs before you buy it;
  • make sure the delivery address you give us is correct and accessible;
  • use suitably licensed, qualified tradespeople where a job calls for one;
  • wait until you have received and checked an item before booking installation, where practical;
  • hold off installing anything that looks damaged, faulty, incomplete or wrong; and
  • check everything is there before disposing of the packaging.

18. Chargebacks and Disputed Payments

If a chargeback or payment dispute is raised for an order that has already been shipped, delivered, collected, or specially ordered, we may share relevant records — order details, tracking history, proof of delivery, payment information and correspondence — with the payment provider or bank handling the dispute.

19. Our Website, Its Content and Intellectual Property

Using our website and buying from us is also subject to our Privacy Policy and any other policies we publish.

Everything on our site — text, images, logos, product write-ups, photographs, layout and design — belongs to us or is used under licence, unless we say otherwise. You may not copy, reproduce, redistribute, alter or reuse any of it without our written permission, except as the law allows.

20. When Things Are Out of Our Hands

We will not be held responsible for delays or failing to meet our obligations where that is caused by something genuinely beyond our control — supplier disruptions, freight and transport issues, natural disasters, fire, flood, pandemic, a cyber incident, industrial action, power outages, government action, carrier delays, and similar events.

21. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute connected to these Terms, or to goods we have supplied, falls under the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia, without affecting any consumer rights you are entitled to.
